The Ryan Haight Act requires practitioners issuing a prescription for a CS to conduct an in-person medical evaluation or conduct a video/audio communication in a DEA-registered facility at a minimum of once every 24 months.
However, with the DEA’s loosened rules( for Covid), providers can now issue a prescription for a CS without first conducting an in-person examination, provided all of the following conditions are met:
The prescription is issued for a legitimate medical purpose by a practitioner acting in the usual course of their professional practice;
Telemedicine communication is conducted using an audio-visual, real-time, and two-way interactive communication system; and the practitioner is acting in accordance with applicable federal and state laws.
We are happy, that the covid restrictions were provisional and set to expire with the conclusion of the public health emergency, ending in July 2022. Every patient needs to be seen in person, have a physical exam, Urine drug screen, counseling, discussion about pros and cons, family conferences, etc.
Better for patient safety IMO.
